1. Agreement to Terms

By accessing or using the Elite Performance Exclusive LLC website ("Site") or any of our services, you agree to be bound by these Terms & Conditions. If you do not agree, do not use our services.

2. Services

Elite Performance Exclusive LLC provides two categories of services:

• Car Rentals: Rent-to-own vehicle program with weekly payment plans (Eco, Live, Apex).
• Tech Solutions: Custom web and mobile application development, maintenance, and support.

3. Car Rental Terms

3.1 Eligibility

To rent a vehicle, you must:

• Be at least 21 years of age.
• Hold a valid US driver's license that does not expire during the rental term.
• Maintain a personal auto-insurance policy with minimum coverage of 100/300/100 liability and active collision and comprehensive, naming Elite Performance Exclusive LLC as an additional insured.
• Provide the required refundable safety deposit before pickup.
• Complete identity verification through our third-party provider, Persona. Insurance is confirmed by phone with your carrier.

3.2 Payment

Weekly payments are due in advance. Late payments may result in vehicle recovery. All payment methods are accepted.

3.3 Deposits

Deposits are fully refundable when the vehicle is returned in good condition per the renter's agreement. Deposit amounts: Eco ($500), Live ($750), Apex ($1,000).

3.4 Vehicle Care & Damage Responsibility

You are fully responsible for any damage, loss, or destruction to the vehicle that occurs during the rental period — including accidents, collisions, vandalism, theft, interior damage (smoking, stains, tears), missing parts or keys, off-road or racing use, and mechanical damage caused by misuse, neglect, or operator error.

Your safety deposit and your personal auto-insurance policy will be applied first. If those amounts are insufficient, you remain liable for the balance.

Elite Performance Exclusive LLC covers only: scheduled monthly maintenance (oil, tire rotation, brake inspection), normal wear and tear, manufacturer defects covered by an active warranty, mechanical breakdowns NOT caused by misuse, and roadside assistance for non-fault mechanical breakdowns (tow, jump-start, manufacturer-key lockout).

Fees apply for: smoking ($250), excessive trash ($150), damage assessment ($100 plus actual repair cost). You are also responsible for tickets, tolls, parking citations, and impound fees incurred during the rental.

3.5 Geofence

Vehicles must remain within the agreed metropolitan geofence at all times. Unlimited miles are included within this area. Travelling outside the geofence without prior written approval incurs a $100 fee per occurrence plus mileage at $0.45/mile and may result in immediate termination of the agreement.

3.6 Rent-to-Own (Apex Plan)

The Apex plan is a 12-month structured-rental program. Completing 12 consecutive months of weekly payments transfers vehicle ownership to you and the title is delivered in your name.

Disclosure of total cost: Total weekly payments over the 12-month term equal $18,200 (52 weeks × $350). No interest is computed and no credit is extended. The Apex plan is not an installment loan and does not appear on your credit report. Early termination forfeits the rent-to-own benefit; the safety deposit is returned per the agreement, less any outstanding fees.

Default: Non-payment beyond 14 days, lapse of insurance, or material breach allows Elite Performance Exclusive LLC to terminate the agreement and recover the vehicle without further notice. Title transfer occurs only after the final payment clears and any outstanding fees are settled.

3.7 Late & default fees

Late payments incur a $35 fee after a 3-day grace period. Detailed fee schedules (smoking, trash, damage, geofence, late payment) are listed in the rental agreement signed at the start of each term.

Non-payment of damage charges assessed under Section 3.4 within 14 days of written notice is a default event under the rental agreement and authorizes Elite Performance Exclusive LLC to recover the vehicle.

3.8 Background checks & FCRA

By submitting a rental application, you authorize Elite Performance Exclusive LLC to obtain a consumer report (a Motor Vehicle Report on every plan; a criminal background check additionally for the Apex rent-to-own plan) from Checkr, Inc., a consumer reporting agency. You have rights under the federal Fair Credit Reporting Act (FCRA), including:

• The right to receive a free copy of any report obtained.
• The right to dispute the accuracy or completeness of any information in the report directly with Checkr.
• The right to a written summary of your rights under the FCRA.

If we intend to take adverse action based in whole or part on a report, we will send you a pre-adverse action notice with a copy of the report, wait at least 5 business days for you to dispute the report, and then send a final adverse action notice if the decision stands.

3.9 Arbitration & venue

Any dispute arising out of a rental agreement shall be resolved by binding arbitration under the American Arbitration Association's rules in the state of Elite Performance Exclusive LLC's principal office. Each party waives any right to a jury trial or to participate in any class action.

4. Tech Services Terms

4.1 Project Scope

All tech projects are scoped through a discovery phase. Pricing is based on the agreed scope. Changes to scope may affect pricing and timeline.

4.2 Deliverables

Every project includes source code handoff, documentation, and deployment. Maintenance plans are available separately.

4.3 Payment

Payment terms are agreed per project. Typically: deposit upfront, milestones, and final payment on delivery.

5. Intellectual Property

All content on this Site (text, design, logos, code) is the property of Elite Performance Exclusive LLC. You may not reproduce, distribute, or create derivative works without written permission.

6. Limitation of Liability

Elite Performance Exclusive LLC is not liable for indirect, incidental, or consequential damages arising from the use of our services or this Site. Our liability is limited to the amount you paid for the specific service.

7. Data Collection

We collect certain data as described in our Privacy Policy, including geolocation data for traffic analytics and cookies for site functionality.

8. Changes to Terms

We may update these terms at any time. Continued use of the Site after changes constitutes acceptance of the new terms.
